Terms of Service

1. Acceptance of Terms

By accessing and using SkipTo ("the Service"), you agree to be bound by these Terms of Service ("ToS"). If you do not agree to these terms, you must not use the Service.

These ToS constitute a legally binding agreement between you and the operator of SkipTo, an individual entrepreneur based in Fribourg, Switzerland.

2. Service Description

SkipTo is a video analysis web application that:

• Analyzes online videos (YouTube, Vimeo, etc.) using AI transcription
• Extracts topics, keywords, and timestamps from video content
• Calculates personalized match scores based on your interests and expertise
• Verifies sources cited in videos and evaluates author credibility
• Provides intelligent recommendations (watch, skip, save for later)

The Service uses artificial intelligence (OpenAI Whisper for transcription, GPT-4 for analysis) to generate personalized insights.

3. Account Creation

3.1 Registration Requirements

To use SkipTo, you must:

• Be at least 16 years old
• Provide accurate and complete information
• Keep your information up to date
• Have a valid email address

3.2 Account Responsibility

You are responsible for:

• The confidentiality of your password and login credentials
• All activities performed under your account
• Notifying us immediately of any unauthorized use of your account

4. Pricing and Payments

4.1 Available Plans

SkipTo offers three subscription plans:

• Free Plan: 5 video credits per month, basic analysis features
• Starter Plan ($12/month or $120/year): 25 video credits per month, full analysis, unlimited history, source verification, email notifications
• Pro Plan ($29/month or $290/year): 75 video credits per month, priority processing, advanced filters, API access (coming soon)

Prices are displayed in US dollars (USD).

4.2 Credit Top-ups

Additional credits can be purchased as one-time add-ons. Purchased credits never expire and are used before monthly quota.

4.3 Billing and Payment

Payments are securely processed via Stripe. We accept credit cards (Visa, Mastercard, American Express) and other payment methods available in your region.

• Monthly subscriptions are billed on the same day each month
• Annual subscriptions are billed once for 12 months
• The first billing occurs immediately upon subscription
• An electronic invoice is sent to you by email after each payment

4.4 Automatic Renewal

Subscriptions automatically renew at the end of each period (monthly or annual) unless you cancel. You will be billed at the rate in effect at the time of renewal.

In case of price changes, you will be notified at least 30 days in advance by email. The change will take effect upon your next renewal.

4.5 Right of Withdrawal

In accordance with Swiss consumer protection legislation (LCD - Unfair Competition Act), you have a period of 14 days from your subscription to exercise your right of withdrawal without having to justify your reason.

To exercise this right, contact us at hello@skipto.app clearly stating your intention to withdraw. A full refund will be granted within 14 days.

4.6 Cancellation

You can cancel your subscription at any time from your user account. The cancellation will take effect at the end of the current period.

• No pro-rata refund is made for the current period
• You retain access to paid features until the expiration date
• After expiration, your account automatically reverts to the free plan
• Your data remains retained according to our privacy policy
• Purchased bonus credits remain available after downgrade

4.7 Service Suspension and Modification

We reserve the right to suspend or modify the plans, prices and features offered, with 30 days notice for any substantial modification affecting existing subscriptions.

In case of non-payment, your access to paid features will be suspended until regularization. After 30 days of non-payment, your account will revert to the free plan.

5. Use of the Service

5.1 License to Use

Subject to compliance with these ToS, we grant you a limited, non-exclusive, non-transferable and revocable license to use the Service for personal and non-commercial purposes.

5.2 Usage Restrictions

You agree not to:

• Use the Service for illegal or unauthorized purposes
• Attempt to access unauthorized systems, data or accounts
• Disrupt or interfere with the Service or servers (DDoS attacks, spam, etc.)
• Use robots, scrapers or other automated tools without authorization
• Resell, rent or commercially exploit the Service without authorization
• Modify, adapt, translate or create derivative works from the Service
• Impersonate another person
• Circumvent security measures or rate limiting
• Analyze videos you don't have the right to access

6. Intellectual Property

6.1 SkipTo Property

The Service, including the code, algorithms, design, logos, and all content, are the exclusive property of SkipTo and are protected by copyright, trademark and other intellectual property laws.

6.2 Your Data

You retain all rights to your personal data. By using the Service, you grant us a license to process your data solely for the purpose of providing the Service.

6.3 Video Content

SkipTo does not claim ownership of the videos you analyze. You are responsible for ensuring you have the right to access and analyze the videos you submit to the Service.

7. Warnings and Limitations

7.1 Informational Nature

⚠️ IMPORTANT: The analyses provided by SkipTo (match scores, summaries, source verification, recommendations) are based on AI algorithms and estimates. They have indicative value only and should not be considered as absolute truth or professional advice.

7.2 Data Accuracy

The accuracy of the analyses depends on:

• The quality of video audio and transcription
• The accuracy of your profile information (interests, expertise levels)
• The availability and accuracy of source information
• AI model limitations and potential biases

We do not guarantee the absolute accuracy of the results.

7.3 Third-party Content

SkipTo analyzes content from third-party platforms (YouTube, Vimeo, etc.). We are not responsible for the content, accuracy, or availability of these third-party videos.

8. Service Availability

We strive to keep the Service accessible 24/7, but we do not guarantee:

• Uninterrupted availability of the Service
• The absence of errors or bugs
• Immediate correction of defects
• Availability of third-party video platforms

We may temporarily suspend the Service for maintenance, updates or security reasons.

9. Limitation of Liability

To the fullest extent permitted by applicable law:

• The Service is provided "as is" without warranty of any kind
• We are not liable for direct, indirect, incidental or consequential damages resulting from the use of the Service
• We are not liable for decisions made based on the Service's recommendations
• Our total liability is limited to the amount you have paid for the Service in the past 12 months

You use the Service at your own risk and under your own responsibility.

10. Indemnification

You agree to indemnify and hold SkipTo harmless from any claims, damages, losses or expenses (including legal fees) resulting from:

• Your violation of these ToS
• Your violation of third party rights
• Your use of the Service
• Any content you submit or analyze through the Service

11. Termination

11.1 By You

You can delete your account at any time from the settings. This results in the permanent deletion of all your data within 30 days.

11.2 By SkipTo

We may suspend or terminate your account immediately and without notice if:

• You violate these ToS
• Your behavior harms the Service or other users
• We are legally required to do so
• We decide to cease operating the Service

12. Modifications to the ToS

We reserve the right to modify these ToS at any time. Modifications will take effect upon publication on the Service.

In case of substantial modification, we will notify you by email (address associated with your account). Continued use of the Service after notification constitutes your acceptance of the modified ToS.

13. Applicable Law and Jurisdiction

13.1 Applicable Law

These ToS are governed by Swiss law, to the exclusion of conflict of law rules.

13.2 Jurisdiction

Any dispute will be subject to the exclusive jurisdiction of the courts of the canton of the operator's domicile (Switzerland), unless otherwise required by law.

13.3 Dispute Resolution (EU)

For users in the European Union, the European Commission provides an online dispute resolution platform (ODR) accessible at: https://ec.europa.eu/consumers/odr

14. Miscellaneous Provisions

14.1 Entire Agreement

These ToS, together with our Privacy Policy, constitute the entire agreement between you and SkipTo regarding the Service.

14.2 Severability

If any provision of these ToS is found to be invalid or unenforceable, the other provisions shall remain in effect.

14.3 Waiver

Failure to exercise a right under these ToS does not constitute a waiver of that right.
